Urheberrechtslage aus dem Jenseits

Guten Morgen, zusammen.

Anlässlich der herbstlichen Zeit (und einfach, weil ich tierisch Bock drauf habe ) würde ich gern "Aus dem Jenseits" (From Beyond) von H.P. Lovecraft vertonen.
Geschrieben hat er das Ding 1920, wäre also von den Urheberrechtsvorgaben hier bei Librivox abgedeckt. Die Erstveröffentlichung war allerdings erst 1934 (wobei ich nicht mal konkret sagen kann, wann die deutsche Erstveröffentlichung war).
Hinzu kommt: Wenn die deutsche Erstveröffentlichung außerhalb des Vertonungsfenster liegen sollte, wie ist das, wenn ich von dem Originaltext, sofern dieser innerhalb des Librivox-Zeitfenster liegen sollte, eine eigene Übersetzung anfertige? Dann wäre diese Übersetzung ja mein Urheberrecht.

Ich glaube, das war jetzt deutlich komplizierter formuliert, als notwendig, aber ich hoffe, ihr versteh trotzdem, was ich meine.

As long as you can find a text on gutenberg.org marked as public domain in USA, that text should be safe for Librivox. "From Beyond" is in the public domain even though it was published in 1934 (it didn't have its copyright renewed when it should).
But for Librivox purposes, any translation should also be in the public domain, which I don't think you'll find in this case.
(And for German copyright, if you are located in Germany, you'd need the translator's date of death to ascertain public domain status in Germany.)
