When books enter the public domain annually (1926/2022, 1927/2023, 1928/2024) if Hathitrust.org "forgets" to update because the year moves forward but it still says "protected by copyright law", can Librivox confidently go by the copyright date itself and disregard Hathi?

For our purposes, for works published over, say, 90 years ago, yes. US copyright is much more complicated than that (with copyright renewals and such that might have made something fall into the PD when they weren't done), and when you get into the 1970s or so, then the death year of the author matters. But if you ignore the copyright renewal exception and stick with works that fall into the PD after 95 years, then yes - the nationality or length of life of the author, where the book was published, etc. don't matter.Ah, thanks for catching that.
