The Nature of the Judicial Process by Benjamin N. Cardozo (1870 - 1938).

Benjamin N. Cardozo, one of the most influential American justists of his era, served as the New York Court of Appeals Chief Justice, before joining the Supreme Court. His 1921 book The Nature of the Judicial Process, now considered a legal classic, was compiled from The Storrs Lectures delivered at Yale Law School earlier that year. In it he analyzes various factors underlying judicial decisions, and how these decisions in their turn influence the development of law, contrasting abstract ideals with court practice, and comparing American and English common law with legal systems of continental Europe.

From Lecture I: "The directive force of a principle may be exerted along the line of logical progression; this I will call the rule of analogy or the method of philosophy; along the line of historical development; this I will call the method of evolution; along the line of the customs of the community; this I will call the method of tradition; along the lines of justice, morals and social welfare, the mores of the day; and this I will call the method of sociology." Section 1 is ready for PL. Since it's fairly long, I've posted a notice in Listeners Wanted.

I realized that the book is even shorter than I estimated at first, and all the lectures will fit into individual sections, so I'll need only half of the rows in the MW.

Michael, I've reviewed section I. Your reading is professional, to say the least. Your voice is very easy to listen to--calm yet surprisingly expressive. Your tone and pacing are most appropriate to the material, and your diction is clear.

There are several instances in which you close the quotation but did not open it:
8:49 (bottom page 15)
15:55 (middle 21)
18:59 (bottom 23)
29:19 (bottom 32)
32:07 (top 34)
47:21 (middle 47)

A few typos, which affect the substance of the text:

2:39 There (not therefore) before us, is the brew (pp 10-11)
3:50 They may, however, with comparative (not comparable) readiness be isolated and tagged (bottom 11)
5:13 a sense in James's phrase (not praise) (bottom 12)
28:26 at least it is the heir (not hair) presumptive (top 31)

Finally, could you check the pronunciation of equivocal (appears at 48:38, text in the middle of 48). I have not heard it pronounced as you do (equi-vo-cal, with equal emphasis on all three syllables), but as eh-qui'-vah-cull, emphasis on the second syllable.

Otherwise, PL OK and a great job. I'm looking forward to listening to the next sections.

I've made changes to address the following:

equivocal (appears at 48:38, text in the middle of 48)

The handling of quotes in the places you point out was intentional. I only spell out quotation marks when I feel it's indispensable for comprehension. I omitted the opening quotation mark in those cases because the start of the quote was signaled by the wording of the text.

Section 1 is PL OK. I understand now your handling of quotation marks and won't note them again. And I am truly impressed by your pickups--they are indistinguishable from the original text, which is damned hard to do.

Another great reading, about which I have just three observations.

There is an extraneous noise at 1:58--perhaps something brushing against the microphone?

4:32 No lawgiver meditating (not mediating) a code of laws conceived the system of feudal tenures.
12:01 and viewed askance (should the emphasis be on the second syllable, rather than the first?) because of some novel aspect of form or feature

The recording meets the standard quality level, so correcting these points is up to you. Again, another great job. I look forward to listening to parts 3 and 4.
