I am certain that I pronounced "pictorial" with and without the "i." It's the same word to me, but I can make it consistent if you insist.
Mike, This is a very interesting contribution. I listened to it this morning. But before I accept it for the Nonfiction Collection, could you please help me out with your sourcing. I can see that it originates from a U.S. government site: https://www.uscourts.gov/. Generally speaking, material originating from the U.S. Government is in the public domain, but to be sure about this case summary I would like to be able reach the court case myself, by accessing it through the U.S. government site.

Could you please tell me the "route" through which you navigated on the web to reach this source. I can see there is a page on the uscourts site called " https://www.pacer.gov/ for accessing electronic files; but I also also see that I would have to sign up for an account to use it. I also see there is a charge for accessing "Pacer" and that there is a disclaimer under the
question "Is All Case Information Available to the Public. " that "some documents may be unavailable to the general public." So, while I think this would be a great addition to our collection, I need your help on this one. Thanks in advance, :)
Hi Sue. PACER is a scam. :P To be honest, I have been following this case since the district court decision and just used the name I knew to find the .gov link through Google when this appellate opinion dropped. You can get there through the main site as well!

2) Click "Opinions and Oral Arguments" https://www.ca3.uscourts.gov/opinions-and-oral-arguments
3) Click "Recent Precedential Opinions" https://www.ca3.uscourts.gov/opinions-and-oral-arguments (The case will only be listed on this page until the end of the month, but there is an internal search that can be used for finding it later.)
4) Click "Silvertop Associates Inc v. Kangaroo Manfacturing Inc" https://www2.ca3.uscourts.gov/opinarch/182266p.pdf (lol, they misspelled it)

A few errors noted:

6:33 forgot end quote after “an intrinsic utilitarian function that is not merely to portray the appearance of the article or to convey information.

7:05 forgot end quote after “is eligible for copyright if, when identified and imagined apart from the useful article, it would qualify as a pictorial, graphic, or sculptural work either on its own or when fixed in some other tangible medium.

8:09 after The second requirement, which is “ordinarily more difficult to satisfy,” requires “that the separately identified feature has the capacity to exist apart from the utilitarian aspects of the article.” Id. forgot to read this p. 7 (“In other words, the feature must be able to exist as its own pictorial, graphic, or sculptural work as defined in § 101 once it is imagined apart from the useful article.”)

13:51 A judge’s own aesthetic judgments must play no role in copyright analysis. After this forgot to read: See Star Athletica, 137 S. Ct. at 1015. “Our inquiry is limited to how the article and feature[s] are perceived, not how or why they were designed.”

Thank you, David, for these two selections on the place of books in public and private life! :) As always your steady, clear reading voice draws the listener into the topics you've chosen and settles them down for a good listen! It's always fascinating, at least to me, to find out what an individual thinks of as the "essential books" to keep in their lives, and for this reason I think our listeners will particularly enjoy Frederick Niven's essay.

Well, here is a piece that I mistakenly recorded for another project.
Would it be appropriate for this collection?
It is a speech by the then newly elected Prime Minister of England, Sir Henry Campbell-Bannerman in 1905, and does reflect some interesting turning points in history.
