Are these old books recordable?

Just wondering whether these are fair game:

Looks like they won't be available permanently but they are full scans with copyright pages - does that suffice?

Let's discuss it on an individual basis if there is something you particularly need to read and it is not available on a more accessible basis.
" During the beta period you can search and view all of the books for free." is not a particularly encouraging remark.

We would need to know about the rights they claim etc, I had a swift look but it is complex.
