PD status of HTML editions from CervantesVirtual.com

This is a prominent site hosting texts taken from pre-1924 sources (among other things). It's often the first choice of our readers for Spanish contributions. In many cases, the site provides bibliographical information and an image of the title page of the book, but makes only an HTML version available. I skimmed through their legal page, and the following gave me pause:
That doesn't sound like PD to me. Thoughts?

It says that "the INSTITUTIONS and / or the FOUNDATION hold exclusive rights pertaining to reproduction, distribution and public communication for the digital editions made by them of works in the public domain."4.3.4.- De conformidad con lo dispuesto en las Leyes española y mexicana de Propiedad Intelectual, corresponden a las INSTITUCIONES y/o la FUNDACIÓN los derechos exclusivos conexos de reproducción, distribución y comunicación pública sobre las ediciones digitales realizadas por las mismas de obras de dominio público.
That doesn't sound like PD to me. Thoughts?
