I also have a question. DuctTapeGuy, you were talking about PG audiobook of The Time Machine. It also says it's copyrighted. But http://www.botar.us/timemachine.html also has a copy of the EXACT same files. And says it's PD. Can anyone clarify what the copy status of it is? Thanks.
From what I can read on the Gutenberg Page, The text and the recording of it are public domain. The references to project Gutenberg are trademarked and under copyright. This would be to protect the Project Gutenberg name from being attached to a commercial product. If I'm reading the conditions right, if a person strips away reference to Gutenberg, and uses only the text from the book, then it is in public domain.

Can you repost chapter 1? I am so sorry but I managed to lose off my server and when I got my new computer.

Yes, I will, let me just edit one more chapter. And I'll make an intro for all three of them.

And I was not talking about the computerized recording, but gutenbergs human recorded version.

That's clearly copyrighted, according to the HTML file included with the book. The reader, Roy Trumbull, is a podcaster himself, http://www.storyspieler.com/ so you could contact him about using the reading for yours.

From a really superficial look at the botar site, unless they have written permission from the reader, they are ignoring his copyright. "Creating this work from public domain print editions means that no one owns a United States copyright on this work" is not actually true in my understanding -- no-one can copyright the core text, but a given performance is copyrighted to the performer.
There's honestly no such thing as a stupid question -- but I'm afraid I can't rule out giving a stupid answer : : To Posterity and Beyond!

I disagree, Sean. It's PG's mess-up, the file clearly says:

The part you quote is legal boilerplate that goes into every book, and in this case, shouldn't be there. And while TBOL3 could use that in court, if he needed to ... I don't think it's really fair to Roy because it wasn't his intent to make his version PD (as far as I can see from that file.)

I don't really understand why you'd want to podcast it, though, TBOL3 ... you're recording your own version after all. Why not use that..?
